I’m a little “l” Libertarian, mainly because I believe that the country needs a strong Reagan style foreign policy to protect us while we indulge in our Libertarian debaucheries. I have a place in my heart for anti-establishment rebels who believe in liberty over law, freedom over formality. That being said, I don’t have a place in my heart for suicidal “tax protester” and the newest hero of the Alex Jones set, Ed Brown.
Brown is now barricaded in his home, refusing to come out until the Government bows to his demands that he not have to pay the back taxes he owes, since he and his wife hadn’t paid taxes for more then a decade. The wife Elaine Brown made most of the money, and admitted that she “did some research” to conclude that paying taxes was unconstitutional.
In other words, like Wesley Snipes, she got suckered. Now the U.S. Marshals are going to take her house to pay the back taxes.
Elaine went to court, presented her case, and now resides in Massachusetts with her son. Ed however, has stayed in his New Hampshire home and called for support from other kooks, telling them they should come to his house armed and help him shoot it out with the feds. That, however, isn’t where he lost me, although anyone seeking to overthrow my government is my enemy.
No, Ed lost me before that, as all his ilk do, with their conspiracy mongering about “Zionists,” their unseemly desire for martyrdom, their links with the unsavory “patriot” movement which seems to be comprised of neo-Nazi’s, abductees, and the assorted tin foil enthusiasts who are the unfortunate fringe of Libertarianism. Make no mistake, Ed Brown has claimed, in this interview posted on GunShowOnThe Net, that taxes are part of the larger conspiracy by “Zionists,” that the U.S. government is responsible for 9/11, and that the only way to “glory” is through dying by his side in defense of his property.
And there are plenty of folks drinking his kool-aid. Like the guy who conducted the above interview Kenneth Hensley, whose website is dedicated to raising funds to buy a bus ticket there so he can fight the feds with his new hero. Ken’s not alone – the N.W.O. nuts who were all over the Internet in the 90’s are converging on Brown’s house with guns to fight our government.
It should be noted that officials haven’t yet threatened him, they haven’t done anything outside their jobs. The Browns dodged their taxes and got caught. Now they owe back taxes. They can’t pay, and thus will have their house auctioned off. They got suckered into thinking they could use a convoluted argument avoid taxes, and it turned out they were wrong.
Now that the law’s caught up with him, Ed wants as many people as possible to come and die a glorious death in his burning house, which he hopes the feds will set alight Waco style. This isn’t patriotism, it isn’t even paranoia. This is insanity. And supporting him will feed into it.
Ed Brown isn’t a hero, he’s a crank, a man who refuses to take any responsibility for his own actions and worse, wants others to pay the ultimate price so that he can continue to avoid being held responsible.
If people die in New Hampshire in the coming weeks, the responsibility will lay not at the feet of the civil servants doing their jobs, but at the doorstep of a conspiracy theorist, and the loathesome Internet rabble who support him.
What a waste of energy you spent writing this article on Ed Brown. Instead of just spewing garbage, why don’t you show everyone where he’s wrong about the Income Tax? Show us all, Einstein.

The income tax is less then 100 years old, or so I hear, where is the law that makes this legal? it seems very anti-American to me.

The law that makes the income tax legal by the way is the Sixteenth Amendment by the way.
I’m for a repeal of income tax myself, but I would do it by running for office and introducing legislation, not getting a buch of marks to shoot it out with the feds. I also would pay for the repeal by abolishing social security, unemployment insurence and public libraries, because unless we pay taxes there’d be none of that. Oh, and I’d make home owners pave their own roads and fix their own power lines. If I were a radical Tax dodger that is. I’m happy to pay reasonable taxes to have a public library, but that’s another discussion.
Also, people didn’t leave the old world because they were Libertarians concerned with big government, they left to escape violent persecution by nuts who beleived Puritans/Jews/random folk were part of a conspiracy to hurt their country. Our first pilgrims would flee Brown and his supporters as surely as they fled the Church of England.
And a serious question, why is it up to everyone else to prove Ed wrong? He’s the one breaking the law, I say he should prove to me he’s right. Can any of you actually prove income tax is illegal without resorting to convoluted theories that have been already discredited? Can you show me where in the Constitution it says income taxes are illegal? Our representitives implemented the income tax, and it is through our representitives that the tax should be repealed. Let me “think” about this one first. Your point is that reading “mainstream rags” makes me ignorant and that you getting all your info from websites (run by people who may or may not be retarded) makes you better educated? Are you kidding? My counter points are thus:
A) Your 16th amendment arguement has been tried in court. More then once. If you had a library card (but I know you don’t, you wouldn’t want “the man” to know where you are) you could read up on the long, sordid, and ultimately criminal history of the so-called tax protester movement. So why don’t you put your energy into changing the law, instead of breaking it?
B) 100’s of taxes? Besides state and sales tax, and sometimes things like estate taxes (which I’m against), name these taxes. Or is this warmed over “tribe,” which I take it means “tripe” which is what we educated people say.
C) Not having been bullied on a playground I’m unfamiliar with what part of me saying that begging people to come shoot it out with the feds is wrong is to be considered bullying. Is it my insistence that we follow the rule of law, or my not believing that shooting U.S. Marshals is heroic? You tell me.
D) Aaron Russo’s a hillbilly and a communist agent. And like most people he doesn’t actually know what Fascism is. Fascism is a form of Socialism where the state uses an established religion as the basis for social policy and national pride. Rob, I assume by your rhetoric that you work in some way for the Federal Government. You have been propositioned to answer the question of what law makes us liable for an income tax and your response is the same as the DOJ and IRS…..the 16th admendment.
Well sir, this either proves that you are an “agent” of the Fed or a sadly uninformed citizen. The 16th amendment bestowed no new taxing power on Congress. So if there could not be a tax on labor before the 16th amendment then it can not be used as an excuse to tax our labor since. This is the law as confirmed by the US Supreme Court on several occasions.
Title 26 is 100% constitutional and legal, however, the way it is applied is a 100% illegal and unconstitutional. Income has been defined by the Supreme Court to mean “profit from corporate gain”. I don’t know about you but most people are not “corporations” so they can’t have corporate gain which means they are not liable.
Now, on to your other position about challenge the law in court to get it overturned…….this once again either shows you’re an agent or a uninformed citizen. You say that the 16th amendment argument has been tried in court (btw, I do have a library card), and as I stated above the Supreme Court has decided that. Unfortunately when it comes to tax cases the lower Federal courts they ignore the Supreme Court! Noone who challenges tax laws of the Fed get a fair trial. They are not allowed to present evidence about the law in any form. In fact in one case not to long ago the presiding Judge angrily announced to the defendent….”I will not allow the law in my courtroom”. Then the judge issues instructions to the jury, and most citizens not knowing there rights as a juror, follow those instructions that are so narrow as to basically be a directed verdict of guilty. So you see there is no challenging the law in court.
So you see sir that your position is weak, that is why you resort to name calling and propoganda. That is typical of agents of the state. You proffer that Aaron Russo is a communist crank, without any proof just conjecture, when in reality his documentary is factual and precise. You as an agent of the state must not like it because it threatens your income base.

In closing I will say to you Rob…..I am a lawyer…..I know how to read case law and apply statutes. I have seen first hand how the Federal Courts handle tax cases. There is no chance of a fair trial for anyone accused of “tax evasion” or “willfull failure to file”, you will be found guilty unless one of the jurors exercises their right to use his\her own judgement and ignore the judges instructions and ask questions of the court…..such as what law (statute) makes a persons wages subject to Title 26. Only then will a person be found not guilty.

You and your kind amaze me…….instead of debating on the facts of a subject you instead choose to resort to name calling and innuendo in a feeble attempt to discredit anyone who presents facts you are unable to rebut.
As I have said in previous post, I believe that Mr. Brown has chosen the wrong path to protest the violation of his rights that will, unfortunately, probably lead to his death.
With that said, I pose this question to you;
What in your opinion is the remedy when your rights are violated and the justice systems ignores your complaint? If your answer is that you would just take it and move on then please send me your Full Name, Address, and SS number so I can send you a bill for a non-existent debt.
The only difference between me sending you a bill for a non-existent debt and the IRS sending you a bill is that if you don’t pay the IRS’s they will illegally, administratively without due process of law, send a notice of levy to your bank, notice of garnishment to your employer, and place notice of lien upon your real property(all of which are not ordered by a court) . I on the other hand would have to do it the correct way by bringing suit against you in a court of law, specifically stating what cause of action or statute that you have violated that created a liability on your part, and proving it with legally admissable evidence.
In previous post you make the assertion that you believe in the rule of law and if someone disagrees with the law they should get an attorney and challenge it. IF you truly believe that then you will agree that the Supreme Court is the law of the land. So my question to you is how do you challenge an illegal action of the government when the inferior lower federal courts ignore the Supreme Court? The Doctrine of Precedent is fundamentally the most important legal doctrine of the rule of law in this country, but in every tax case it is ignored. Federal judges in the lower courts routinely ignore all Supreme Court decisions regarding taxation and due process.
I must say that any response you have to this that does not address the facts in a competent manner, free from defamation or innuendo about anyone, will serve to prove that either you are just an uneducated person just trying to feel important or an agent provocateur attempting to obfuscate the real truth from your fellow americans.
This issue with Mr. Brown, while tragic, is serving as a rallying cry to millions of americans who are becoming more aware that they have been misled by the federal government on the tax issue, among other things, and will increasingly bring pressure to bare on our elected representatives to end the fraud being committed by the IRS and the Federal Reserve.
Bill, you’re tacitly approving a group of people planning to kill their fellow Americans. But that’s your right. The reason I’m not going to have an endless debate about the legalities of tax protesting is because I have a business (for which I pay taxes) to run. I will be posting several items about Brown you’ll find equally offensive in the coming days.

I must apologize to you for getting detoured from the initial point you made. As I have stated before, I do not agree with the way Mr. Brown is handling his situation. I am not in anyway supporting his “call to arms” and personally think it is repulsive. My point as to the rallying cry was to political action not military. Hopefully it will serve as a “call to arms” for the people to use the greatest weapon at their disposal……..the vote. When someone comes to your front door with guns to conduct “their business” through force I would assume it was a robbery. The tax collectors who brandish these weapons in an aggressive manner can not expect to have force met with anything less lethal or legal.

The 16th Amendment gave no new taxking power. Google Supreme court cases and “income tax” and read: The income tax is an INDIRECT or EXCISE tax on an ACTIVITY OR PRIVILEDGE, and the “income” is merely the “yardstick” or used to deteremine the “tax.” Don’t believe me…check the Supreme Court Cases. And….
“The income tax is, therefore, not a tax on incomes as such. It is an excise taxes with respect to certain activities and priviledge which is measured by reference to the income which they produce…”.House Congressional Record march 27th, 1943, page 2580.
I’ll start by stating my position on the income tax thing. Income tax is slavery plain and simple. I consider it to be unconstitutional going by the constitution in it’s original form (not including any amendments). If there is a law or no law I think it is unjust to force taxation on American’s. I’m certainly no expert at the constitution I am going by what I know only. Right or wrong it’s what I believe our founders intended. I am a radical Libertarian so you know. At the same time I’m not suicidal enough to face down the feds with a hand full of people over some money. One reason being I believe if you can muster enough support for your cause the government would conform or we would end up in civil war. Either way taking on feds with a hand full of people and is not the smartest thing one could do. Bottom line is brains before guns folks!

I dont believe he should be recruiting innocent people to his home either, and requesting they are armed, that is absolutely nuts. I do however understand Ed’s point, where is the law saying you have to pay federal income tax? you have mentioned he broke the law several times, which law? That is the real problem, and whenever the IRS is confronted with this question they can not, and will not answer it, because there is none.
As far as the comment about Ed being a conspiracy theorist, have you read any of the information thats out there? or do you just believe everything your govt tells you ? You should really do some of your “OWN” research before you make comments like this. Whether or not Eds a conspiracy theorists has nothing to do with whats happening in this particular case. Where is the law? show me the law? thats what Ed wants to know. Where is the law saying he has to pay federal income tax? I am challenging you to show us all as well.

Many of you (joe I’m looking at you) are saying that I should “do my own research” and should “show you the law” as if it’s my responsibility to get you to pay taxes. It isn’t, I don’t care if you do or don’t. I pay mine, but then again, I’m a law abiding citizen. But to answer your questions
All conspiracy theorists tend to be completly wrong about everything. This is because of the insulated community of websites and conventions that act as sounding boards for any crazy theory some con artist who wants you to by their self published book can come up with. For example, more then one of you here claimed that Federal income tax was only being used to “pay down the deficit.” It’s an idea that obviously gets around. Well, if that’s true, where does the money for federal entitlements come from? Aid money to other countries? The billions the U.N. sucks up? What about the money to build aircraft carriers? Who pays the President? I ran a Faith in Action program once, which is a federal grant, where’d that money come from?
The point about conspiracy theorists is that they often start out on the wrong foot logic wise. Arguing that the 16th amendment wasn’t ratified (and I can’t find any lawyer or historian that makes that claim) is one thing, then saying that the reason no court finds in favor of that claim is because the Jews/illuminati/Raelians secretly control the government can and SHOULD cast doubt on how logical that claim is.
Researching an argument by “googling” is unacceptable in undergraduate college courses, and hopefully high schools, why is it used for something as important as this? I can find plenty of web pages that claim anything and site it as evidence. For example I could show you a thousand pages authored by Muslims claiming Christianity is paganism. Is that true? Pointing out websites, especially commercial ones, that support your position isn’t sufficient evidence that something is true for my taste. Court records, consultations with lawyers, hell I’d be asking my state representitives to give me sworn statements if I thought this was true. Research involves compiling data, not surfing websites.

This is ridiculous. You are somehow trying to equate being a civil servant with innocence. They aren’t the same. Just because you are assigned a task by the government doesn’t mean that you represent what is legal. Any man who knowingly does what is illegal is not innocent and it doesn’t matter if they are FBI,CIA or US troops. Those “civil servants” are the greatest enemy that America has. Blind idiots doing what they are told and never questioning the legality of their orders. Our own children rob us of our freedoms.
America is an ideology not a job. Our ideals are based on the law and its enforcment. What we believe about democracy is the only thing that seperates a man from a slave.
If these “civil servants” come to compromise our ideals what should be done?
Should we pay our taxes until things change, even though beyond a shadow of a doubt they are not enforcible by any constitutional reference? Well Rob surprise! This is how things change. One person stands up and the masses rally around him until the change is complete or until or government kills everyone not on their team.
We should rally around Mr Brown because although he stands for himself, he represents every American. We should be willing to sacrifice for our freedoms because once they are gone, we are all slaves. Not slaves like people who get arrested for nothing or can’t speak out, but slaves like the African Americans were 500 years ago.
That is what a people look like who have no liberty. Take a hard look Rob. That is what they look like. This oppression will never stop. It will never right itself and it will never favor the average American. It will only get worse and worse. Have you read the Patriot Act? How about Patriot Act 2?
Unfortunately Ed Brown is a microcosm of a much bigger issue that eventually will lead to Americans rallying, but at what cost. Its quite obvious whose side that you are on.

We are taxed more than enough in the marketplace, and with fees and licenses of every kind to pay for all our roads, cops, hospitals and the other good stuff.
Our government is a wasteful, insane glutton, no matter what pinhead from the Dems or Repubs is in charge. The last election, featuring stooges who were both distant cousins and members of a secret club, offered no real choice.
As for the secret club, Skull and Bones, which I’m sure will get me an ad-hominem attack from Rob, all I can say is that it’s fishy when two of the men who want the highest office clam up when asked about it.
Our money is based on making it out of thin air. Checkbook notes; electronic computer credits. Whatever you may think of my views, you’ve had YOUR WAY since 1913, when the Federal Reserve was set up, and we are drowning in debt, plus, the Great Depression took place while we had the Fed, which was one of the things the Fed’s men promised it would prevent.

No one likes taxes, but they are necessary. Forget the “show me the law” and all the numerous arguments that have been shot down by numerous courts. Whoops, I forgot – all the judges and IRS employees are engaged in a vast conspiracy along with the U.S. Government employees that blew up the World Tade Center!
Get over it, and quit supporting the rich kooks that refuse to pay their share….or move to another country where taxes are higher.
